State
Practice - The firm's experience, resources and highly trained staff make
it well-equipped to handle complex eminent domain litigation across the state.
Pre-Condemnation Planning - Eminent domain cases
involve many issues that can affect the final outcome of a case.
Because actions taken by a land owner prior to the actual "taking" of
property can impact the case, it is important for a landowner to
consult with us as soon he or she becomes aware of governmental
activities that may affect their property. We can then quickly assess the
relevant information and a potential case in order to assist landowners in
preparing for a pending condemnation.
Trial Litigation - Some cases require resolution by
jury trial. The Firm's litigation team is composed of a complete judicial
department of the Eighth Judicial District Court, the very same venue where all
cases from Southern Nevada are tried. This litigation power is combined with
extensive experience in the development of valuation strategies to present a
landowner's claims to the jury.
Inverse Condemnation & Regulatory Takings -
Many times,
governmental activities result in the "taking" of private property without
the filing of formal condemnation proceedings. Whether the government has
physically encroached upon private property in the creation of a public
project, or applied a regulatory provision that denies the use of the
property, a "taking" requiring the payment of just compensation might have occurred.
